1. Agreement to Terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between you and JDL Enterprises Limited ("Company", "we", "us", or "our") concerning your access to and use of Ouvert, including our website located at https://ouvert.dev, our mobile application, Twitch bot, and any related services (collectively, the "Services").
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our Services.
2. About Ouvert
Ouvert is a song request service designed for rhythm games. Our Services allow users to request songs that are added to a queue system for playback in rhythm gaming environments, including through Twitch integration and our mobile application.
3. Eligibility
To use our Services, you must:
- Be at least 13 years of age (or the age of majority in your jurisdiction if higher)
- Have the legal capacity to enter into binding agreements
- If you are under 18, you must have parental or guardian consent to use our Services
- Comply with all applicable laws and regulations
4. User Accounts
Some features of our Services may require you to create an account. When creating an account, you agree to:

- Maintain and update your account information as necessary
- Maintain the security of your account credentials
- Accept responsibility for all activities that occur under your account

5. Song Requests and Queue System
5.1 Request Submission
When submitting song requests through our Services, you agree to:
- Only request songs that you have the right to request and play
- Respect any request limits set by administrators or our system
- Not abuse the queue system or attempt to manipulate it
- Follow any additional guidelines provided by Twitch channel administrators
5.2 Queue Management
Ouvert operates a queue system where song requests are processed in order. We reserve the right to:
- Set and modify queue limits per user
- Implement timeframe limitations on requests
- Prioritize or reorder requests as necessary
- Remove or skip requests that violate these Terms
- Clear or modify the queue as needed
6. Acceptable Use
You agree not to use our Services to:
- Violate any applicable laws or regulations
- Infringe upon intellectual property rights of others
- Request or distribute copyrighted material without proper authorization
- Harass, threaten, or harm other users
- Interfere with or disrupt the Services or servers
- Attempt to gain unauthorized access to any part of the Services
- Use automated systems (bots, scripts) to abuse the Services
- Spam or flood the queue with excessive requests
- Impersonate others or provide false information
7. Intellectual Property
All content, features, and functionality of the Services, including but not limited to text, graphics, logos, icons, images, and software, are the exclusive property of JDL Enterprises Limited or its licensors and are protected by copyright, trademark, and other intellectual property laws.
You may not copy, reproduce, distribute, modify, create derivative works, publicly display, or otherwise exploit any part of the Services without our prior written permission.
8. Copyright and DMCA
Ouvert respects intellectual property rights and expects users to do the same. If you believe that any content available through our Services infringes your copyright, please contact us at contact@jdl-enterprises.co.uk with:
- A description of the copyrighted work claimed to have been infringed
- Identification of the material that is claimed to be infringing
- Your contact information
- A statement of good faith belief that the use is not authorized
- A statement that the information is accurate and you are authorized to act on behalf of the copyright owner

We do not warrant that the Services will be uninterrupted, secure, or error-free, or that defects will be corrected.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, JDL ENTERPRISES LIMITED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICES.

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of England and Wales.
